Service Availability & Modifications

All services are provided “AS IS” and “AS AVAILABLE.” We do not guarantee uninterrupted access or error-free performance. We are not liable for any downtime, delays, or technical failures.

XARITES THE CREATIVE AGENCY reserves the right to modify, suspend, or discontinue any part of our services or website functionality at any time without prior notice. We shall not be liable for any consequences resulting from such changes.

Limitation of Liability & Indemnification

Under no circumstances shall XARITES THE CREATIVE AGENCY’s liability exceed the amount paid by the user for the services in the preceding 12 months.

Referral Partner Program Terms

By applying to and participating in the Xari Partner Program, you agree to the following terms in addition to the general Terms and Conditions outlined on this page:

1. Eligibility & Acceptance

Participation in the Xari Partner Program is subject to approval. We reserve the right to accept or reject any application at our sole discretion, without obligation to disclose the reasoning behind the decision.

2. Referral Attribution & Tracking

All referral tracking is handled via cookie-based URL tracking, with a 60-day attribution window. Referrals are attributed to the partner whose tracking link was used at the time of the initial visit. Xari is not liable for referrals that fail to be tracked due to external user settings, browser configurations, or third-party interference.

3. Commission Structure

Commission rates are outlined on the Xari Partner Program page and are subject to change with 30 days’ notice. Specific commissions include:

Hosting Services: $50 flat per referral
Sentinel X: $100 flat per referral
Digital Marketing Services: $200 flat per referral
Subscription Services: 5% recurring commission for the lifetime of the contract
5-Step Web Design & Development Project: 10% of total project value (e.g., $200–$1,000+ per referral)

All commissions are calculated net of taxes, chargebacks, and client discounts.

4. Payout Timing

Payouts are made on the 5^th of each calendar month, for all eligible commissions earned more than 28 days prior (to allow for contract activation and invoicing). Payments are made via bank transfer.

5. Referral Agreement

Approved partners will be provided with a detailed Referral Agreement that outlines their rights, obligations, and commission entitlements. Continued participation in the program is conditional upon compliance with that agreement.

6. Restrictions

You may not refer your own business or act as both partner and client. Self-referrals or fraudulent leads will result in forfeiture of commissions and removal from the program.

7. Program Termination

XARITES THE CREATIVE AGENCY LLC. reserves the right to suspend or terminate any partner’s participation in the program at any time if abuse, misrepresentation, or non-compliance is identified. Commissions on pending referrals may be withheld under such circumstances.

8. Promotional Guidelines

Partners must represent Xari accurately and professionally. Any misleading, spam-based, or unethical promotional tactics are grounds for removal from the program and forfeiture of commissions.

9. Updates to Partner Terms

These terms are subject to periodic updates. Continued participation in the Partner Program constitutes acceptance of any revised terms, which will be communicated via email or updated on this page.
